By downloading, accessing, or using GameBreakr ("the Service"), you agree to be bound by these Terms of Use (the "EULA"). If you do not agree to these terms, please do not use the Service. The Service is operated by GameBreakr ("we," "us," or "our").
2. Description of Service
GameBreakr is a fantasy sports analytics and advice platform that provides AI-powered player insights, draft tools, matchup analysis, and related content. The Service is intended for entertainment and informational purposes only. We do not facilitate gambling, wagering, or betting of any kind.
3. Accounts
You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and current information during registration and to update it as needed.
4. Subscriptions and Billing
- The Service offers an auto-renewable subscription plan ("GameBreakr+") at $6.99/month or $59.99/year.
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel your subscriptions in your Apple ID Account Settings at any time.
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
- All payments are non-refundable except where required by applicable law.
- We reserve the right to change pricing with reasonable notice. Existing subscribers will be charged the rate in effect at the time of subscription renewal.
5. AI-Generated Content Disclaimer
The Service uses artificial intelligence (including OpenAI and Google Gemini Pro, along with other LLM providers) to generate insights, analysis, and recommendations. All AI-generated content is for informational and entertainment purposes only. We make no guarantees about the accuracy, completeness, or reliability of AI-generated content. You should not rely solely on this content when making decisions. We are not liable for any losses or damages arising from the use of AI-generated advice.
6. No Gambling
GameBreakr does not facilitate, endorse, or profit from sports betting or gambling. The Service provides analytics and opinions only. Users are solely responsible for complying with all applicable gambling laws in their jurisdiction.
7. Third-Party Data
The Service integrates with third-party platforms including ESPN and Sleeper to display player data, rosters, and scores. We are not responsible for the accuracy or availability of third-party data. All third-party trademarks and data are the property of their respective owners.
8. User Conduct
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to disrupt or compromise the Service's security; (c) scrape, copy, or redistribute content without permission; (d) use automated tools to access the Service beyond normal use; or (e) impersonate another person or entity.
9. Intellectual Property
All content, features, and functionality of the Service — including text, graphics, logos, and software — are owned by GameBreakr and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
10. Limitation of Liability
To the maximum extent permitted by law, GameBreakr and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid in the preceding 12 months.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.
12. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will cease immediately.
13. Changes to These Terms
We may update these Terms of Use at any time. We will notify users of significant changes through the Service or via email. Continued use of the Service after changes constitutes acceptance of the updated terms.
